TERMS & CONDITIONS
PARTIES TO THE AGREEMENT:
Luna Pix and you, “the client”, agree the following services will be supplied to the client by Luna Pix until new terms and conditions are agreed upon and notified in writing by all parties involved.
GENERAL:
The minimum charge is $60.
The completed order remains the property of Luna Pix until full payment is made.
The client has read and understood the section on "how it works" and service conditions for both bulk and manual scanning and restoration/editing etc.
QUALITY OF PRODUCT:
The examples given on this site of finished products are of the quality the client will pay for and that the client is aware that the finished product will not look exactly like a modern-day photograph. However, the aim is to make it the "best as possible".
TERMS OF PAYMENT:
Luna Pix will issue an invoice to the client within 5 working days of the client sending their approval/acceptance of the order.
Payment must be made directly to Luna Pix within 14 days of receipt of the invoice. The invoice must be paid prior to the return of the client's photos. We reserve the right to withhold the return of such photos until any outstanding invoices are paid in full.
REFUNDS AND REPLACEMENTS:

Restoration &/or Editing of Photos
Luna Pix seeks the client's acceptance of the finished product/order prior to sending an invoice for payment the invoice is the client's acknowledgment that the order meets their expectations and therefore no refunds will be provided.
Digital Images on USB or HDD supplied by Luna Pix
Before a replacement is considered the item (usb/hdd) is to be returned to Luna Pix within 14 days from the date the client has received the item and then if it is found to be faulty a replacement will be provided. All postage cost in relation to the replacement is to be met by the client.
Other Store Purchases
Before a replacement is considered the item is to be returned to Luna Pix within 14 days from the date the client has received the item and then if it is found to be faulty a replacement will be provided. All postage cost in relation to the replacement is to be met by the client.
CANCELLATION POLICY:
For cancelled orders, the client meets all shipping/postage costs of returning the photographs.
For cancellations made after Luna Pix has commenced work, the client will be charged 100% of the price of work completed, plus a $20 cancellation fee. The total fee is capped at the price of the original order.
SHIPPING/POSTAGE:
Sample Packs
For shipping/postage of sample packs of up to 100 photos, it is the client's responsibility to arrange shipping/postage to Luna Pix, including the cost of all packaging and labeling.
On completion of the project and receipt of payment, Luna Pix will post then the photos and digital images to the client via Australia Post.
Shoebox Scanning
Courier satchels will be posted to the client along with a flat pack box, packaging, and labels.
The client will fill the box with their photos and return them to Luna Pix via Australia Post, on completion of the project Luna Pix will then return the photos and digital images to the client again via Australia Post.
Postage costs will be added to the client's order at online store check-out and will be charged at a flat rate of $50 return for overnight delivery or $36 return for regular delivery (2-4 days).
Note these prices are for packages that are <= 5kg if there is an additional charge then the client is responsible for this extra postage cost.
Manual Scanning and/or Restoration/Editing etc
For shipping/postage of fewer than 500 photos and/or individual photos for scanning/restoration/editing, it is the client's responsibility to arrange shipping/postage to Luna Pix, including the cost of all packaging and labeling.
On completion of the project and receipt of payment, Luna Pix will post then the photos and digital images to the client via Australia Post.
MODIFICATION TO TERMS AND CONDITIONS:
Luna Pix may revise and change these terms and conditions of service at any time without notice. By using this website and our service the client is agreeing to be bound by the current version of these terms and conditions of service.
COPYRIGHT / LIABILITY:
Luna Pix provides a scanning/restoration and image enhancement service. By submitting images for scanning/restoration/slideshow and or digital enhancement, the client authorises Luna Pix to execute any and all work the client orders on the images. The client guarantees that the images are supplied either on themselves or on behalf of or from the copyright holder. By submitting photos to Luna Pix for any of our services the client confirms and guarantees that no copyright has been infringed. Luna Pix will not be liable to the client or any third party for any such copyright infringement. The copyright release is solely the client's responsibility.
INTELLECTUAL PROPERTY AGREEMENT:
All information provided by Luna Pix shall at all times be the property of Luna Pix, including all written, audio & visual material. Nothing in this contract agreement shall be construed as conveying to any party any right, title, or interest in, or to any information or the intellectual property of Luna Pix, or to convey any license to use, sell, exploit, copy, or further develop any such information or intellectual property of Luna Pix.
DISCLAIMER:
The client releases Luna Pix or any agent of it from any liability, risks and complications resulting from the services howsoever arising.
By submitting prints or documents to Luna Pix, the client agrees that their value is no more than the cost of scanning the same quantity of photographs. Except for such agreed value, Luna Pix will not be liable for any other loss or damage, direct, consequential or incidental to the customer’s use of such services.
INDEMNITY:
Luna Pix will provide services (whether physical or electronic) with all due care.
Luna Pix do not give any warranty or guarantees or represent any services or products, or any third-party information, services or products are free from errors or omissions.
CONFIDENTIALITY AND PRIVACY AGREEMENT:
Luna Pix agree not to on-sell, distribute, copy, use, or disseminate any information or media without gaining prior permission and agreement from both parties. At all times during the contract agreement term, all information is treated with full confidentiality and privacy.
